Please read these Terms of Service carefully before utilizing software, tools, automated modules, or informational resources provided by Tenardship.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Tenardship ("Tenardship", "we", "us", or "our"). By visiting our website, signing up for an account, connecting external application programming interfaces (APIs), or using our automated algorithmic trading tools, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not accept these Terms in their entirety, you are strictly prohibited from accessing our systems, and you must discontinue all use of the platform immediately.

2. Eligibility and Account Safeguards

To register for an account and access the Tenardship software suite, you must:

  • Be at least the age of majority in your jurisdiction of residence (e.g., 18 or 19 years old in applicable Canadian provinces and territories).
  • Have full legal capacity and power to enter into a binding contract under applicable laws.
  • Not be located in, organized under, or a resident of any territory subject to comprehensive international sanctions or embargoes.
  • Ensure all registration details provided are accurate, complete, and continuously maintained.

You remain exclusively responsible for securing your account credentials, secret API tokens, two-factor authentication keys, and password hashes. Any transaction, configuration adjustment, or automated order execution triggered through your credentials is conclusively deemed authorized by you.

3. Description of Platform and Autonomous Tools

Tenardship is a technical software platform that delivers predictive market analytics, algorithmic indicators, historical simulations, and self-hosted or cloud-based trading bot connectivity across supported third-party digital asset exchanges, foreign exchange venues, and equity brokerages.

Non-Custodial Architecture: Tenardship does not hold, custody, broker, manage, or receive your fiat funds or digital tokens. All financial settlements and asset transactions are executed directly by your linked third-party trading venues via API keys generated and configured under your sole direction.

4. No Financial, Investment, or Legal Advice

The information, algorithms, indicators, metrics, and automated calculations presented across the Tenardship platform are provided exclusively for computational, educational, and workflow management purposes. Tenardship is not a registered investment advisor, securities dealer, commodity trading advisor, portfolio manager, or financial planner under Canadian provincial securities commissions or equivalent regulatory bodies worldwide.

Nothing accessible on the platform constitutes personalized financial, tax, or legal guidance. You are solely responsible for determining whether any capital allocation or trading strategy aligns with your personal risk tolerance, financial standing, and investment objectives.

5. Prohibited Activities

When interacting with the platform, you agree not to engage in or facilitate any of the following restricted actions:

  • Reverse-engineering, decompiling, disassembling, or extracting the proprietary source code of Tenardship trading models.
  • Deploying bot setups designed to exploit exchange vulnerabilities, execute market wash trading, spoof order books, or manipulate market liquidity.
  • Circumventing platform throttling, rate limits, or geographic authentication verifications.
  • Using Tenardship infrastructure to violate anti-money laundering (AML), counter-terrorist financing (CTF), or sanctions enforcement frameworks.

6. Intellectual Property Rights

All software architectures, user interfaces, proprietary predictive algorithms, graphical assets, trademarks, logs, documentation, and digital assets associated with Tenardship are the exclusive property of Tenardship or its licensors. Except for the revocable, non-exclusive, non-sublicensable personal license granted herein, no title, interest, or proprietary ownership is transferred to you.

7. Disclaimer of Warranties

The Tenardship platform, software services, and all outputs are provided strictly on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by applicable Canadian law, Tenardship explicitly disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, algorithmic uptime, execution precision, and zero computational error.

8. Limitation of Liability

Under no legal theory (whether in contract, tort, negligence, or strict liability) shall Tenardship, its directors, employees, affiliates, or contractors be liable for any direct, indirect, incidental, punitive, or consequential damages, including loss of profits, trading drawdowns, missed executions, market volatility losses, exchange API downtimes, or hardware latency delays. In any event, our cumulative aggregate liability shall not exceed the subscription fees paid by you to Tenardship during the ninety (90) days preceding the incident.

9. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to your use of Tenardship shall be governed by, construed, and enforced in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without giving effect to conflicts of law principles. Any dispute, claim, or controversy shall be resolved exclusively through final and binding arbitration seated in Calgary, Alberta, Canada.

10. Modifications and Inquiries

We reserve the right to amend or replace these Terms at any time. When material updates occur, we will adjust the "Last Updated" timestamp above and provide prominent notification within the software interface. Your continued access to the platform following posted amendments affirms your agreement to the modified Terms.
